Agreement to Terms

By accessing and using BuzzTurn ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our service.

These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

BuzzTurn is a queue management system that helps businesses manage customer queues through SMS notifications, real-time updates, and customer self-service features.

Our service includes:

  • Digital queue management dashboard for businesses
  • SMS notifications to customers
  • Real-time queue visibility for customers
  • Queue cancellation capabilities
  • Wait time estimates and analytics

User Accounts and Registration

To use certain features of the Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and up-to-date information
  • Notifying us immediately of any unauthorized use of your account

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service for any unlawful purpose or to solicit others to perform unlawful acts
  • Violate any international, federal, provincial, or local regulations, rules, or laws
  • Transmit or procure the sending of any advertising or promotional material without our prior written consent
  • Impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • Use the Service in any manner that could disable, overburden, damage, or impair the Service
  • Add customers to your waitlist or send messages using customer phone numbers without their explicit prior consent
  • Send inappropriate, offensive, harassing, threatening, defamatory, or otherwise harmful messages to customers
  • Send spam, unsolicited marketing messages, or any content unrelated to legitimate waitlist management communications
  • Use the Service to send messages that violate SMS compliance regulations, including TCPA (Telephone Consumer Protection Act) or similar laws in your jurisdiction

Customer Consent and Communication Requirements

As a business user of BuzzTurn, when you manually add customers to your waitlist, you are responsible for accurately indicating their SMS consent status in our system.

When manually adding customers to the waitlist, you must:

  • Obtain explicit verbal or written consent from customers before collecting their phone number and adding them to your waitlist
  • Ask customers whether they consent to receive SMS notifications about their waitlist status
  • Accurately set the SMS consent checkbox based on the customer's actual response - only check the box if the customer has explicitly agreed to receive text messages

For customers who use self check-in features (QR codes, kiosk mode, or online self-service), our system automatically captures their SMS consent preference during the check-in process, and you are not responsible for setting their consent status.

BuzzTurn's system automatically handles SMS delivery, opt-out management, and consent record keeping based on the consent status provided. Messages will only be sent to customers whose SMS consent is confirmed. When customers opt out, our system automatically updates their consent status. You are solely responsible for ensuring that the consent checkbox accurately reflects each customer's actual consent when you manually add them. Misrepresenting customer consent is a serious violation of these Terms.

By using our Service, you acknowledge that you understand and will comply with all applicable SMS compliance laws, including but not limited to the Telephone Consumer Protection Act (TCPA) and similar regulations in your jurisdiction.

SMS and Communications

By using our Service, you consent to receive SMS messages and other communications from us. Message and data rates may apply.

You can opt out of SMS communications at any time by replying STOP to any message or by contacting us directly.

Payment and Billing

If you purchase a paid plan, you agree to pay all charges associated with your account. All payments are non-refundable unless otherwise stated.

We reserve the right to change our pricing at any time with reasonable notice.

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

By using the Service, you consent to the collection and use of information in accordance with our Privacy Policy.

Service Availability

We strive to provide reliable service but cannot guarantee that the Service will be available at all times. We may suspend or terminate the Service for maintenance, updates, or other reasons with or without notice.

Limitation of Liability

In no event shall BuzzTurn, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless BuzzTurn and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) resulting from your use of the Service or violation of these Terms.

Violations and Account Suspension

Violation of these Terms, particularly regarding customer consent and appropriate messaging, may result in immediate action against your account.

Depending on the severity of the violation, we may:

  • Issue a warning and require immediate corrective action
  • Temporarily restrict or disable specific features, including SMS messaging capabilities
  • Suspend your account pending investigation
  • Permanently terminate your account and access to the Service
  • Report violations to relevant authorities if required by law

Specific violations that may result in account suspension or termination include, but are not limited to:

  • Adding customers without their consent
  • Sending spam, inappropriate, or harmful messages
  • Violating SMS compliance regulations (TCPA or equivalent)
  • Using the Service for fraudulent or illegal purposes
  • Repeatedly violating these Terms after warnings

We reserve the right to suspend or terminate accounts at our sole discretion to protect our platform, our reputation, and the customers you serve.

Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where BuzzTurn is incorporated, without regard to its conflict of law provisions.
